DMCA Policy

1. Overview

Carry my Words is a private, point-to-point message delivery service: messages are never hosted publicly and are visible only to the sender and the specific recipient(s) the sender designates. We nonetheless respect the intellectual property rights of others and have adopted this Copyright Policy in accordance with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512, to address claims of copyright infringement involving content submitted, stored, or delivered through our platform.

2. Designated Agent for Copyright Notices

If you believe that content stored on or delivered through Carry my Words infringes your copyright, please send a written notice to our Designated Agent: Carry My Words, LLC, Attn: DMCA Designated Agent, 131 Continental Dr, Suite 305, Newark, DE 19713, United States, or by email to info@carrymywords.com with the subject line "DMCA Notice." Our designated agent is registered with the U.S. Copyright Office (Registration No. DMCA-1080080, effective September 8, 2026) and listed in the DMCA Designated Agent Directory at dmca.copyright.gov.

3. Filing a Notice of Claimed Infringement

To be effective under 17 U.S.C. § 512(c)(3)(A), your written notice must include: a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; identification of the copyrighted work you claim has been infringed; identification of the specific material you claim is infringing and information reasonably sufficient to allow us to locate it within our systems; your address, telephone number, and email address; a statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf. Because Carry my Words delivers content privately rather than hosting it publicly, we can only act on a notice that identifies material we are able to locate and verify within our systems.

4. Our Response to a Valid Notice

Upon receipt of a notice that substantially complies with these requirements, we will remove or disable access to the identified material, notify the account holder who submitted it, and give that user the opportunity to submit a counter-notification as described below. We may decline to act on a notice that we determine, in good faith, to be incomplete, abusive, or invalid.

5. Counter-Notification Procedure

If you believe material you submitted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our Designated Agent. To be effective under 17 U.S.C. § 512(g)(3), it must include: your physical or electronic signature; identification of the material that was removed or disabled and its location before removal; a statement, made under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification; your name, address, and telephone number; and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or, if outside the United States, any judicial district in which Carry My Words may be found), and that you will accept service of process from the person who submitted the original notice or their agent. Absent a court action filed by the original complaining party, we may restore the material within 10 to 14 business days of receiving a valid counter-notification.

6. Repeat Infringer Policy

In appropriate circumstances and at our sole discretion, Carry my Words will terminate the accounts of users who are determined to be repeat infringers of the copyrights or other intellectual property rights of others, consistent with Section 12 (Termination) of our Terms of Service.

7. Misrepresentations

Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing, or that material was removed or disabled as a result of mistake or misidentification, may be liable for damages, including costs and attorneys' fees incurred by us or the affected user.
